Aeonis Flood (“the Service”) at flood.aeonis.pro is operated by AEONIS LLC, a Florida limited liability company (“we”, “us”). By using the Service you agree to these terms.
1. Information only, not advice
The Service automatically summarizes public government data for a map location. Reports are provided for general information. A report is not an official flood zone determination (including FEMA Form 086-0-32), an elevation certificate, a survey, an appraisal, an inspection, an insurance quote or binder, or legal, insurance, financial or real estate advice. We are not an insurance agency, surveyor, lender or law firm. Do not use a report as the sole basis for a purchase, lending, insurance, construction or disclosure decision. Confirm important facts with FEMA, your lender, a licensed insurance agent, a licensed surveyor or engineer, and an attorney where appropriate.
2. Data accuracy
Data comes from third parties including FEMA, USGS, NOAA, the U.S. Census Bureau and OpenStreetMap contributors. It may be incomplete, outdated, approximate or wrong, and sources may be unavailable. Flood maps change, address locations are approximate, and flooding can occur in any zone. We do not guarantee that any report is accurate, complete or current. This product uses the FEMA OpenFEMA API and National Flood Hazard Layer, but is not endorsed by FEMA. The Federal Government or FEMA cannot vouch for the data or analyses derived from these data after the data have been retrieved from the Agency's website(s).
3. Acceptable use
Use the Service lawfully and reasonably. Don't scrape it in bulk, bypass rate limits, resell reports as an official determination, or misrepresent a report's source or nature. We may limit or block use that burdens the Service or its data providers. Fair-use limits apply to free reports.
4. Shared reports
Each report gets an unguessable link. Anyone with the link can view it, so share it carefully. Reports contain the address or coordinates you entered and public data only.
5. Early access and paid plans
Joining early access is free and creates no obligation. Paid plans (Aeonis Flood Pro: Pro, Agent and Team) are sold as monthly or yearly subscriptions through Gumroad, which processes the payment and acts as the seller of record. The price, billing period and included limits are shown before purchase. Subscriptions renew automatically at the end of each period until you cancel. You can cancel anytime from your Gumroad receipt or library, and you keep access until the end of the period you paid for. Monthly report allowances, monitored-address limits and batch sizes are fair-use limits stated on the pricing page; unused reports don't roll over. We may change prices for future periods with at least 30 days' notice by email, and you can cancel before the change takes effect. Your license key is for your organization's use; don't publish or resell it.
5a. Refunds
You can cancel anytime and keep access until the end of the paid period. We refund a first payment requested within 14 days, and any charge made in error. Requests: ronald@aeonis.pro.
5c. Pro features: your responsibilities
Branded reports. You're responsible for the name, logo, license number and contact details you add, and you must have the right to use them. Branded reports keep our data sources and disclaimer; don't remove them or present a report as an official flood zone determination or as your own survey. Lead widget. When visitors submit their details through your widget, you decide how to use them and you are responsible for contacting them lawfully (including telemarketing, texting and do-not-call rules such as the TCPA and Florida's telemarketing laws) and for honoring opt-outs. We collect each visitor's consent to be contacted by you and store it with the lead. We process leads on your behalf and don't contact them or sell them. Monitoring. Saved addresses are re-checked against FEMA's public map about once a week; checks can be delayed when FEMA's services are unavailable, and FEMA can change maps without notice. Monitoring is an information aid, not a guarantee that every change will be caught. Data after cancellation. Profiles, saved addresses and leads are deleted about 90 days after your subscription ends; download your leads before then.
5b. Third-party data
Reports include data from third parties under their own terms, including OpenStreetMap data under the Open Database License (ODbL). You may not use the Service to bulk-extract that data. See Data sources.
6. Disclaimer of warranties
THE SERVICE AND ALL REPORTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT.
7. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, AEONIS LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM RELIANCE ON A REPORT, INCLUDING FLOOD DAMAGE, INSURANCE COSTS OR TRANSACTION LOSSES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR $50.
8. Indemnity
You agree to indemnify AEONIS LLC against claims arising from your misuse of the Service or your violation of these terms.
9. Governing law
These terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Venue lies in the state or federal courts located in Broward County, Florida.
